ACCIDENT REPORTS
Notice of death or disappearance of person
- When, as a result of a collision, accident or other casualty involving a vessel or its equipment, a person dies or disappears from the vessel, the operator shall, without delay and by the quickest means available notify the nearest representative of the Department. The notice must include:
- The date, time and exact location of the occurrence;
- The name of each person who died or disappeared;
- The identification number and name of the vessel; and
- The name and address of the owner and the operator.
- If the operator of the vessel cannot give the notice, each person on board the vessel shall notify the Department or determine that the notice has been given.
Report concerning certain occurrences
- The operator of a vessel shall submit to the Department a report, on a form provided by the Department or the United States Coast Guard, whenever as a result of an occurrence involving the vessel or its equipment:
- A person dies;
- A person is injured and receives medical treatment beyond first aid;
- Damage occurs to the vessel and other property which totals more than $500; or
- A person disappears from the vessel under circumstances indicating his death or injury.
- The report must be submitted within 48 hours after the occurrence if a person dies within 24 hours after the occurrence, is injured and receives medical treatment beyond first aid, or disappears from the vessel.
- The report must be submitted within 10 days after the occurrence or death if an earlier report is not required.
- If the operator of the vessel cannot submit the report, the owner shall submit it.
